Court adopted in full the magistrate judge’s findings and recommendations to deny defendant’s motion to compel arbitration. Magistrate judge had determined that the agreement plaintiff signed contained a valid arbitration agreement, but this agreement did not apply to plaintiff by virtue of a carve-out notice provision. –Brown v.
