It is the mutual intent of Expeditors and Rose to establish procedures to facilitate the informal and inexpensive resolution of any disputes arising under this Agreement by mutual cooperation and without resort to litigation. Accordingly, any controversy, dispute or claim arising out of or relating to this Agreement shall be resolved in accordance with the following procedures which call for negotiation and settlement. Only if negotiation shall fail will Expeditors and Rose resort to mediation and only if mediation shall fail will Expeditors and Rose resort to arbitration. -Peter Rose Employee Agreement (2008)
