Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by binding arbitration in accordance with Commercial Arbitration Rules of the American Arbitration Association in Washington, DC. The arbitrator may, in his/her discretion, award reasonable attorneys’ fees and costs to either party. Notwithstanding the foregoing, the Company may seek injunctive relief in a court of competent jurisdiction if the Executive breaches Section 5 or 6 hereof. -Andrew Hines Employee Agreement (2000)
