Defendants Acosta, Inc., Mosaic Parent Holdings, Inc., and Mosaic Sales Solutions US Operating Co., LLC (collectively “Mosaic”), move to compel plaintiff Rudy Trevino to arbitrate his California Labor Code claims, and do so as an individual. In support of their motion, Mosaic cites the arbitration agreement that includes a class action waiver that Trevino purportedly signed. In opposition, Trevino argues that the arbitration agreement is unenforceable because: (1) it is illegal, (2) Mosaic cannot show mutual assent; and (3) it is unconscionable. -Trevino v. Any controversy, claim or dispute between the parties relating to the Consultant’s services or termination of services, whether or not the controversy, claim or dispute arises under this Agreement, shall be resolved by arbitration in accordance with the Employment Arbitration Rules and Mediation Procedures (“Rules”) of the American Arbitration Association through a single arbitrator selected in accordance with the Rules. -William Mitchell Employment Services Agreement (2017)
