Court granted defendant’s motion to compel arbitration and stay proceedings pending the outcome of arbitration, as the plaintiff initiated an arbitration agreement as part of the electronic employment onboarding process.  Court rejected plaintiff’s arguments that the arbitration agreement was invalid due to procedural unconscionability because it was a contract of adhesion and because a copy of the applicable arbitration rules had not been provided to him.  Court further rejected that the arbitration agreement was invalid due to substantive unconscionability because it failed to provide for adequate discovery, because defendant and its counsel would have an inequitable advantage in arbitration as “repeat players,” and because it contained an illegal waiver of representative claims under the Private Attorney General Act. –Shoals v. Owens & Minor Distribution, Inc. (2018)
