You agree not to file a lawsuit or request arbitration asserting claims released by you in this Section 5. You agree that if you violate this Agreement by suing the Company Releasees with respect to a claim released by you in this Section 5, you will pay all reasonable costs and expenses of defending the suit incurred by the Company Releasees; this provision does not apply, however, to costs or fees for actions brought pursuant to the ADEA. This release does not extend to your rights under any Rockwell Automation health or welfare plan, policy or program or retirement, pension or deferred compensation benefit plan or other future claims arising after you sign this Agreement, or to any claim that cannot be released herein as a matter of law. -James Gelly Employee Agreement (2007)
